Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Anantix's website located at anantix.pages.dev and all services provided by Anantix ("we", "our", "us"). By accessing our website, contacting us, or purchasing any service, you agree to be legally bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, you must not use our website or engage our services.

2. Services

Anantix provides digital and software services including but not limited to:

• Custom software and management system development
• Website and landing page design and development
• SaaS platform development
• Business automation and AI workflow solutions
• Social media management and content creation
• Email marketing and lead generation campaigns

The specific scope, deliverables, timeline, and pricing for each engagement are defined in the proposal or invoice issued prior to commencement of work. These Terms apply to all engagements unless a separate written agreement supersedes them.

3. Client Responsibilities

To enable Anantix to deliver services effectively, you agree to:

• Provide accurate, complete, and timely information, materials, and access required for the project
• Designate a point of contact who has authority to make decisions on your behalf
• Review and provide feedback on deliverables within 5 business days of receipt
• Make payments by the due dates specified in your invoice
• Ensure that any content, images, or materials you supply do not infringe third-party intellectual property rights

Delays caused by the client's failure to meet these responsibilities do not entitle the client to a refund, compensation, or extension of any SLA.

4. Payment Terms

All prices are quoted in USD unless otherwise stated. Payment terms are as follows:

• A deposit (typically 50% of the total project value) is required before work commences
• The remaining balance is due upon project completion or as specified in the invoice
• Recurring service fees are billed monthly in advance and are non-refundable
• Invoices not paid within 7 days of the due date may result in suspension of work or services
• Overdue balances accrue interest at 1.5% per month

5. Intellectual Property

Upon receipt of full payment, Anantix assigns to the client all intellectual property rights in custom deliverables created specifically for that client ("Work Product"). Until full payment is received, all Work Product remains the sole property of Anantix.

Anantix retains the right to:

• Use any tools, frameworks, libraries, or methodologies that are not client-specific
• Display completed work in our portfolio, unless the client requests confidentiality in writing
• Reuse general-purpose code, components, or templates across multiple client projects

6. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement. Anantix will not disclose client business information, data, or materials to third parties without written consent, except as required by law.

7. Warranties and Limitation of Liability

Anantix warrants that services will be delivered with reasonable skill and care. However, to the maximum extent permitted by applicable law:

• We do not guarantee specific business outcomes, revenue results, or search rankings
• We are not liable for third-party service outages (hosting, APIs, social platforms, payment gateways)
• Our total liability for any claim shall not exceed the amount paid by the client for the specific service giving rise to the claim
• We are not liable for indirect, consequential, or incidental damages of any kind

8. Cancellation and Refunds

Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. By agreeing to these Terms you also accept the Refund Policy in full.

9. Termination

Either party may terminate an engagement with 15 days' written notice. Upon termination:

• All outstanding balances for work completed to date become immediately due
• Anantix will deliver all completed Work Product for which full payment has been received
• Work in progress may be delivered in its current state at Anantix's discretion
• No refunds will be issued for work already performed

10. Governing Law

These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration. The language of arbitration shall be English.

11. Use of Third-Party Services

Anantix may use third-party tools, platforms, and APIs (including Meta, Google, OpenAI, and others) to deliver its services. By engaging Anantix, you acknowledge that your project may interact with these third-party services and agree to comply with their respective terms of use.

12. Amendments

Anantix reserves the right to update these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of our services after any changes constitutes acceptance of the updated Terms.
